Important guidance from the Court of Justice of the European Union in Koton Mağazacilik Tekstil Sanayi ve Ticaret v EUIPO, C-104/18 P, EU:C:2019:724

The Court of Justice has clarified the concept of ‘bad faith’ in the context of trade mark law and has confirmed that the existence of a likelihood of confusion between the contested mark and a prior mark of the invalidity applicant is not an essential condition for a finding of bad faith and that bad faith may exist in respect of only some of the registered goods/services.
